Decree No. 381/2026/NĐ-CP: Commune-level officials and civil servants are entitled to a 55% civil service allowance

Decree No. 381/2026/NĐ-CP stipulates civil service allowances for officials and civil servants working in agencies of the Party, the State, the Vietnam Fatherland Front, and political and social organizations affiliated with the Vietnam Fatherland Front at the commune, ward, and special zone levels.

This Decree applies to officials and civil servants working in agencies of the Party, the State, the Vietnam Fatherland Front, and political-social organizations affiliated with the Vietnam Fatherland Front at the commune, ward, and special zone levels (hereinafter referred to as “commune-level officials and civil servants”).

Level of Civil Service Allowance

Decree No. 381/2026/NĐ-CP stipulates the civil service allowance as follows:

1- The civil service allowance is equal to 55% of the current salary plus leadership position allowances and seniority allowances exceeding the standard framework (if any), and applies to commune-level officials and civil servants who do not receive salary or additional income pursuant to a resolution of the Provincial or Municipal People’s Council regarding the allocation of salaries and additional income.

2- The civil service allowance rate is 25% of the current salary plus leadership position allowances and seniority allowances exceeding the standard framework (if any), applicable to commune-level officials and civil servants who receive salaries and additional income pursuant to the Resolution of the Provincial or Municipal People’s Council on the allocation of salaries and supplementary income.

3- In cases where commune-level officials and civil servants referred to in paragraph 2 above receive a salary and additional income total that is 55% lower than the civil service allowance, they shall receive the difference to bring their total to the level of the 55% civil service allowance.

Deputy Prime Minister Pham Thi Thanh Tra stated that, following a one-year review of the implementation of the two-tier local government model, the Central Committee decided on a policy to increase the civil service allowance rate for commune-level officials and civil servants from 25% to 55%, representing a 30% increase.

This is a policy prioritized by the Central Committee for the commune level, stemming from the practical requirements of the two-tier local government model, in which the commune level is directly responsible for carrying out many tasks, resolving issues, and serving the people.

The allowance increase is a concrete policy aimed at providing additional incentives and enhancing accountability in the performance of public duties within the new organizational model. This adjustment aligns with the need to continue building a grassroots cadre capable of better meeting the requirements of governance and public service within the two-tier local government model.

Principles of Application

Civil service allowances are paid concurrently with the monthly salary and are not used to calculate contributions to or benefits from social insurance or health insurance.

Periods during which civil service allowances are not payable include:

- Time spent on official business trips, or working or studying abroad, for which 40% of the salary is paid in accordance with Clause 4, Article 8 of Decree No. 204/2004/ND-CP dated December 14, 2004, of the Government on the salary regime for officials, civil servants, public employees, and members of the armed forces;

- Periods of unpaid leave lasting one month or longer;

- Periods of leave during which social insurance benefits are received in accordance with the law on social insurance;

- Periods of temporary suspension from duty or periods of temporary detention or pretrial detention.

Commune-level officials and civil servants who cease working in agencies of the Party, the State, the Vietnam Fatherland Front, or political-social organizations affiliated with the Vietnam Fatherland Front at the commune, ward, or special zone level shall cease to receive the civil service allowance under this Decree starting from the following month.

Funding for the civil service allowance program stipulated in this Decree shall be provided from the state budget and included in the annual salary reform requirements of localities.

The new allowance system shall take effect on July 1, 2026

Decree No. 381/2026/NĐ-CP takes effect on October 2, 2026.

The allowance system stipulated in this Decree shall be applied from July 1, 2026, until the implementation of salary policy reform.

Commune-level officials and civil servants who are subject to the civil service allowance rates specified in paragraphs 1 and 3 above, and who, during the period from July 1, 2026, until the effective date of this Decree, received a civil service allowance lower than 55% of the civil service allowance rate shall be entitled to a difference payment to bring their allowance up to the 55% level.

Decree No. 381/2026/NĐ-CP repeals the relevant provisions regarding commune-level officials and civil servants in Decree No. 34/2012/NĐ-CP dated April 15, 2012, of the Government on the civil service allowance system.
