The government encourages businesses to adopt and innovate with technology

The government has issued Decree No. 101/2026/NĐ-CP, which provides detailed regulations on certain provisions and measures to guide the implementation of the Law on Technology Transfer.

Notably, the decree includes policies to support and encourage businesses to adopt and innovate technology.

This Decree consists of 8 chapters and 69 articles detailing certain provisions of the Technology Transfer Law No. 07/2017/QH14, as amended and supplemented by the Price Law No. 16/2023/QH15, the Law on Science, Technology, and Innovation No. 93/2025/QH15, and the Law Amending and Supplementing Certain Provisions of the Technology Transfer Law No. 115/2025/QH15 regarding: technology appraisal; the technology catalog; management of technology transfer activities; inspection and supervision of technology in investment projects and technology transfer activities; measures to support and promote technology transfer, the application of technological innovations, and the development of the science and technology market; the authority, procedures, and conditions for the operation of organizations engaged in evaluation, valuation, and technology appraisal; and the responsibilities of relevant ministries, sectors, localities, organizations, and individuals.

This Decree applies to agencies, organizations, and individuals involved in technology appraisal; technology transfer; measures to encourage technology transfer, application, and innovation, as well as the development of the science and technology market; and the inspection and supervision of technology in investment projects and technology transfer activities.

Regarding policies to support and encourage technology application and innovation, the Decree stipulates the following four forms of support:

1. Support for enterprises with projects in priority investment sectors or priority investment zones that receive technology transfer from science and technology organizations

Conditions for businesses eligible for support:

a) Have a project in an industry or sector eligible for investment incentives or in an investment-incentive area as defined by investment laws;

b) Have a technology transfer contract or a Certificate of Technology Transfer Registration in accordance with the law on technology transfer;

Forms of support:

Enterprises meeting the above conditions are supported through science, technology, and innovation programs or tasks, or activities to develop innovation systems, startup ecosystems, and promote a culture of innovation and entrepreneurship in accordance with laws on science, technology, and innovation.

2. Encourage forms of cooperation between enterprises and agencies, organizations, and individuals to implement investment projects in technological innovation, innovative startups, and the development of infrastructure supporting the advancement of science, technology, and innovation. Specifically:

The State encourages businesses to cooperate with domestic and foreign agencies, organizations, and individuals, particularly universities, research institutes, innovation centers, and startup support centers, through the following forms (*):

a) Collaborating on technology development and refinement to create prototype products, organize testing, demonstrations, and technology validation; adjusting and mastering technology, production lines, and technical processes based on business needs;

b) Cooperation in technology transfer, commercialization of scientific research outcomes, technology development, and innovation between higher education institutions, research institutes, and science and technology organizations with businesses; establishing businesses based on research outcomes and innovative startups; linking product and service value chains based on technology; organizing business incubation and acceleration programs for science and technology enterprises;

c) Cooperating in training, capacity building, and the shared use of human resources in science, technology, and innovation, including: commissioning technology workforce training; exchanging experts between businesses and higher education institutions and research institutes; placing students, researchers, and engineers for internships and work in businesses linked to research and technological innovation tasks; training and capacity building in research and development, technology management, innovation management, and the development of new business models;

d) Public-private partnerships in investment, management, and operation of laboratories, technical facilities, innovation centers, startup support centers, and incubators; co-working spaces, intermediary organizations in the science and technology market, technical infrastructure, testing and technology demonstration spaces, digital platforms, and databases supporting the application, transfer, and innovation of technology and innovation in accordance with laws on public-private partnership investment and relevant laws;

d) Cooperate in the exploitation and sharing of data and information on technology, scientific research results and technological development, intellectual property, technology needs, and technology experts through the national digital platform for science, technology, and innovation management and related information systems in accordance with the law;

e) Cooperate in building and developing innovation systems and startup ecosystems; develop expert networks; organize seminars, forums, and events to promote a culture of innovation and entrepreneurship.

Enterprises, agencies, organizations, and individuals participating in the forms of cooperation specified in (*) shall be given priority consideration for the application of the following support measures:

a) Receive support in accordance with Article 31 of this Decree for technology innovation investment projects and technology transfer activities that meet the conditions prescribed by laws on investment and laws on technology transfer;

b) Be given priority consideration, be awarded contracts, be directly assigned, or be selected to carry out scientific, technological, and innovation tasks in accordance with laws on science, technology, and innovation;

c) Be given priority in using and accessing services provided by laboratories, technical facilities, innovation centers, startup support centers, incubators, coworking spaces, intermediary organizations in the science and technology market, technical infrastructure, testing and demonstration facilities, digital platforms, and databases;

d) Be given priority for consideration of support through the National Technology Innovation Fund, science, technology, and innovation development funds of ministries, ministerial-level agencies, government agencies, other central-level agencies, provincial People’s Committees, and other legally established funds as prescribed by law;

đ) Be given priority to participate in and receive support as prescribed in Articles 53 and 54 of this Decree and relevant laws; participate in innovation networks, events, and forums—both domestic and international—related to technology, innovation, and creative entrepreneurship;

e) Be given priority for consideration for recognition, awards, and acknowledgment of achievements in science, technology, and innovation in accordance with the law.

Funding for implementing these support measures is allocated from the budget for science, technology, and innovation; the National Technology Innovation Fund; the science, technology, and innovation development funds of ministries, ministerial-level agencies, government agencies, other central-level agencies, and provincial People’s Committees; and science, technology, and innovation programs and tasks.

3. Support for organizations and businesses in technology transfer activities

The Decree stipulates that organizations and businesses eligible for state support in technology transfer activities include: technology transferors, technology recipients, and intermediary organizations in the science and technology market.

These entities are given priority for support and for being commissioned to carry out scientific, technological, and innovation tasks, as well as activities supporting scientific research, technology development, technology application, technology transfer, innovation, and innovative entrepreneurship through the National Technology Innovation Fund, the science, technology, and innovation development funds of ministries, ministerial-level agencies, agencies under the Government, other central agencies, provincial People’s Committees, and other lawful sources of support as prescribed by law.

4. Support for the development of a network of organizations implementing support activities for small and medium-sized enterprises, cooperatives, individual business households, and individual entrepreneurs

The Decree stipulates that the network of organizations specified in Clause 5 of Article 35 of Law No. 07/2017/QH14, as amended and supplemented by Clause 15 of Article 1 of Law No. 115/2025/QH15, shall be prioritized for investment in construction and development from the State budget allocated for science, technology, and innovation.

Support for network development activities is provided through one or more of the following forms:

a) Through science, technology, and innovation programs and projects;

b) Assigning tasks or placing orders with organizations within the network to coordinate in carrying out business support activities;

c) Organizing and supporting the activities of clubs, forums, and networks linking support organizations and businesses;

d) Prioritizing connections and participation in domestic and international platforms, programs, and networks that serve business support activities.

This Decree shall take effect as of April 1, 2026./.
